For the purpose of this contract, “Faint Illusions, LLC” refers to the registered limited liability company and its employees, and “Client” refers to the person and/or business that is paying for the web design and/or logo design services offered by Faint Illusions, LLC. Additionally, “Project” refers to the entire web design or logo design project that the client requests from Faint Illusions, LLC.  The estimated cost of the project and estimated completion date is specified in the Client Information Form or, in some cases, notified verbally.

Client agrees to pay for fifty percent of the total estimated cost of the project before any development of the project takes place. Preliminary discussions related to the project may take place without an initial deposit, but a fifty percent deposit must take place before the development period. If, at any time, the client requests any original copies of images, HTML code, or work-in-progress, Faint Illusions, LLC reserves the right to bill the client for the remaining fifty percent of the estimated project cost. Client agrees that the fifty percent deposit is non-refundable. Client authorizes Faint Illusions, LLC to charge their credit card for the project if they have submitted credit card information using the web design order form or logo design order form. Additionally, the client hereby confirms that they are authorized to submit transactions on the credit card which they have provided to Faint Illusions, LLC. Client authorizes Faint Illusions, LLC to charge the provided credit card for the amount of which is owed. Client understands that the number of days their logo design project will be completed in are business days, which are Monday through Friday, and do not include the day on which the project is requested. Logos may not be completed within the estimated time if the client uses a payment method other than a credit card, and may also take additional time if there are complications with the supplied credit card. If client chooses to include business card design in their project, the client understands that this is a service only, and that there are no physical business cards included. Client is responsible for ordering physical business cards from a separate company, and understands that Faint Illusions, LLC is not responsible for paying for the physical business cards.

Refunds and cancellations: If client cancels any service provided by Faint Illusions, LLC, the initial fifty-percent deposit is non-refundable. In addition, the client may also be charged for the remaining 50% if they have been provided any work-in-progress. Services subject to this agreement include, but are not limited to, web design and logo design. If Faint Illusions, LLC initiates the cancellation of a project, the client will be entitled to a full refund. Additionally, if Faint Illusions, LLC fails to produce a product that is considered to be complete, the client may be entitled to a refund. Refunds and cancellation requests should be made in a timely manner and the client should call 303-642-5240 and/or e-mail contact@faintillusions.com. If the initial transaction involved a credit card and meets our cancellation policy, the client will be refunded fully, without penalty.

Standard web hosting is included with web design services by Faint Illusions, LLC. These standard web hosting services are limited, however, to one-hundred megabytes of server disk space and one gigabyte of server bandwidth per month for a total of one year of web hosting from the date the remaining fifty percent of the project is paid for by the client. Client understands that web design services provided by Faint Illusions, LLC do not include non-standard web hosting unless agreed upon in writing. Client also understands that it is their responsibility to contact Faint Illusions, LLC to renew or transfer hosting and domain names within eleven months of this contract date. Faint Illusions, LLC is not responsible for maintaining the website of the client unless agreed upon in writing. Faint Illusions, LLC is not obligated to renew web hosting or domain names, but must transfer hosting and domain names if they are registered and held by Faint Illusions, LLC.

Faint Illusions, LLC must notify the client if the project will cost more than the estimated amount before the additional work takes place if the ending total project cost is going to be more than ten percent higher than the total estimated project cost. Faint Illusions agrees to finish project within two weeks of the estimated project completion date as specified in the Client Information Form unless the delay is caused by the client.
